On 25th September, 2019, this Court accepted the statement of the applicant that he would pay amount due to the complainant.

In view of the statement, applicant has handed over two cheques amounting to Rs.3,93,000/- to the complainant. Complainant is present and he admits receipt of two cheques.

908-ABA-20822019.odt In view of the facts of the case and the order dated 25th September, 2019, application is allowed. Hence, the following order:

(I) In the event of arrest of the applicant in Crime No.430 of 2019 registered with Borivali P.Stn., he shall be released on executing PR bond in the sum of Rs.10,000/- with one or more sureties in like amount.

(ii) The applicant shall not tamper with the evidence or attempt to infuence or contact the complainant, witnesses or any person concerned with the case; Stand over to 10th January, 2020, to verify whether cheques tendered today are encashed.
