The learned counsel for the Applicant, on instructions, seeks leave to withdraw the Application as according to the learned counsel the Investigating Officer is filing chargesheet shortly. He therefore seeks liberty to approach the learned Sessions Judge afresh for bail after filing of the chargesheet.

In such circumstances, the Criminal Application is disposed of, as withdrawn, with liberty as prayed.

It is made clear that if the Applicant files an Application afresh for bail, the learned Sessions Judge shall decide the same on its own merits and in accordance with law, without being influenced by the withdrawal of the present Application.
