This is an application for bail in C.R.No.613 of 2017, registered with Borivali police station for offences punishable under section 406, 420 read with 34 IPC.
2] Learned APP on instructions submits that the prosecution has examined 12 witnesses and 2 more witnesses are proposed to be examined. The next date before the sessions court is 28th January 2019.
YBG 925-ba-2470-18 3] Considering the aforesaid circumstances, and the evidence on record, bail cannot be granted at this stage. Learned Counsel for the applicant submits that the applicant is in custody since the date of his arrest and hence, the trial court be directed to conclude the trial expeditiously. Considering the fact that the prosecution intends to examine only two more witnesses and the time required for advancing arguments by both sides and recording of evidence of remaining witnesses, the trial court is directed to conclude the trial within two months from today. Defence shall cooperate in speedy disposal of case. Application is disposed of accordingly.
