Heard the learned counsel for the parties.

By an order dated 25th September, 2023 this Court had granted interim bail ascribing reasons.

The learned counsel for the applicant submits that pursuant to the order dated 25th September, 2023 the applicant has appeared before the investigating officer and cooperated with the investigation.

The role attributed to the applicant appears to be that of introducing the first informant to the co-accused Rajesh Gupta. The later has executed a declaration on 14th February, 2020 acknowledging the receipt of Rs. 7 lakhs from the first informant. Vishal Parekar ...1

In the backdrop of the aforesaid role attributed to the applicant and the fact that the applicant has appeared before the investigating officer and cooperated with the investigation, I am impelled to make the order of interim bail absolute. 6.

The order of interim bail dated 25th September, 2023 is made absolute on the terms and conditions incorporated therein. 7.

The applicant shall henceforth attend Kalachowki police station as and when directed.

8.

The applicant shall not tamper with the prosecution evidence and give threat or inducement to first informant, any of the prosecution witnesses or any person acquainted with the facts of the case.

9.

The applicant shall regularly attend the proceedings before the jurisdictional Court.

10.

It is clarified that these prima facie observations are confined to determine entitlement to pre-arrest bail only. Application disposed.
