The Applicant-wife has sought transfer of the proceedings in terms of prayer clause (a), as according to her, the Respondenthusband is attending proceedings, which are initiated by the Applicant at Kolhapur Court under the provisions of the Protection of Women from Domestic Violence Act, 2005 and under Section 125 of the Code of Criminal Procedure for grant of maintenance. 2.

The learned counsel for the Non-Applicant-husband upon instructions from the Non-Applicant, who is personally present in the Court concede the request, provided in all the three proceedings viz. one initiated under the Protection of Women from

Priya 18 mca 42-16-c Domestic Violence Act, 2005, another under Section 125 of the code of Criminal Procedure and the present Hindu Marriage Petition referred to prayer clause (a) in the application are possible on one and the same date.

The submissions as are canvased for the learned counsel for the Respondent appears reasonable. In view thereof, the present application stands allowed in terms of prayer clause (c). It is ordered that the present Hindu Marriage Petition, which is ordered to be transferred from Kolhapur Court to Kalyan Court be posted on one and the same date, on which other two proceedings one initiated under the Protection of Women from Domestic Violence Act, 2005 and another under the provisions of Section 125 of the code of Criminal Procedure are posted. It is further clarified that an endevour is made that all the three matters will be posted on one and the same date, so that the parties will not be put to face difficulties. With the above directions, the Miscellaneous Civil Application is disposed of. (NITIN W. SAMBRE, J.)
