By an order dated 09.10.2017 the applicants were granted interim relief and were directed to attend the Investigating Officer on stipulated dates. The learned Counsel for the applicants submitted that the applicants except applicant No.1 Sagunabai have attended the Investigating Officer and cooperated in the process of investigation. Perused the report of investigation.

It is the prosecution case that the applicants alongwith other accusedpersons forged revenue records, thereby showing enhanced holding of the land from 2.98 acres to 3.80 acres. The documents involved in the present crime are already seized by the police.

After perusing the record of investigation, this Court is of the view that the custodial interrogation of the Applicants is not necessary for the further investigation of present crime.

In view thereof, interim relief granted by an Order dated 09.10.2017 is hereby confirmed. However, the condition to attend the Investigating Officer is waived.
