Heard learned counsel for the parties 2.

Learned Counsel for the Respondent states on instructions, that the Respondent, without prejudice to his rights and contentions before the trial Court is ready to pay a sum of Rs.5,000/- to the petitioner per month, by way of interim arrears from the date of the order i.e. from 9th August, 2018, till the proceedings before the Family Court are finally decided.

In view of the aforesaid, learned counsel for the petitioner does not press this petition. He submits that the petitioner is also accepting the said amount of Rs.5,000/- per month without prejudice to her rights

Learned Counsel for the Respondent states that the respondent will clear the arrears within six weeks from today. Statement accepted. 5.

Accordingly, the respondent to continue to pay at the rate of Rs.5,000/- per month to the petitioner, without prejudice to his rights in the trial Court and the petitioner also accepts the same, without prejudice to her rights and contentions before the trial Court. 6.

It is made clear that the aforesaid amount i.e. Rs.5,000/- per month is quantified, without prejudice to the rights and contentions of either of the parties before the trial Court. The learned Judge to decide the case on its own merits. All contentions of both the parties are kept open. 7.

Petition is accordingly disposed of as withdrawn on the aforesaid terms.
