By an Order dated 26.9.2018 the applicant was granted interim relief. Heard the learned counsel appearing for the applicant and the learned APP. Perused the-record.

Mr. Kolekar, the learned counsel appearing for the applicant submitted that by Order dated 25.9.2018, co-accused Uttam Kamble who has been - Page-1/2

Nalawade 23-aba-1980-18.doc attributed with similar allegations and same role has been granted pre arrest bail by this Court and therefore, the applicant is entitled to claim parity. The learned APP. fairly conceded to the said fact. 3.

After presuming the entire record, this Court is of the considered view that applicant has been also attributed with same and similar role as has been attributed to co-accused Uttam Kamble and therefore, the applicant is entitled to pre-arrest bail on the ground of parity.

In view of the facts and circumstances of the present case the applicant deserves to be protected by pre arrest bail.

The interim relief granted by Order dated 26.9.2018 is hereby confirmed.
