By this Application, the Applicant is seeking anticipatory bail in connection with investigation of Crime No.I-403/2019 registered with Rabale Police Station, Navi Mumbai under Section 498-A, 406 and 506 r/w. Section 34 of IPC. The Applicant who is husband of the Complainant is original Accused No.1.

I have heard the learned counsels for the parties. Perused record.

The record discloses that this Court granted interim protection to the Applicant on 27 September 2019 which is operating till today.

The learned APP submitted that the investigation is complete and the chargesheet is filed on 27 January 2021. On 13 August 2021, the Applicant had expressed willingness to handover the articles of the Complainant which were lying in the matrimonial house. Learned APP submits that on 27 September 2019, the Complainant visited the matrimonial house in presence of the Investigating Officer and has taken away the articles in respect of which a panchanama is drawn. A copy of the said panchanama is produced on record and marked 'X' for identification. It is submitted that the custody of the Applicant is not required.

In such circumstances, the Criminal Application is disposed of in terms of the order dated 27 September 2019. (C. V. BHADANG, J.) Mamta Kale page 2 of 2
