This is an application for anticipatory bail in connection CR No.I-220 of 2018 registered with Kapur Bawdi Police Station for offences under Sections 454, 452 read with Section 34 of Indian Penal Code.

The applicant along with other accused has preferred an application for anticipatory bail before the Sessions Court, which was allowed as far as other accused are concerned, however, the relief was refused to the applicant. In the last paragraph of the said order it is stated that custody of applicant would be necessary for investigation and the say filed by investigating officer indicate that applicants have kept some idols of Lord Ganesh in front of door so that no one can enter into the room which can create hurdle in the investigation.

The applicant was granted interim protection vide order dated 26th September 2018 with direction to report the investigating officer.

Learned APP submitted that the applicant has reported only once on 28th September 2018. Learned APP further submitted that the applicant is in possession of premises which is subject matter of the complaint which is allegedly forcefully taken against the order of Court. It appears that civil proceedings were initiated by parties. Considering the nature of allegations, interim protection granted by this Court deserves to be confirmed.

Hence, I pass following order :

ORDER

(i) Criminal Anticipatory Bail Application No.1985 of 2018 is allowed and disposed off;

(ii) In the event of arrest of applicant in connection with CR No.I220 of 2018 registered with Kapur Bawdi Police Station, the applicant be released on bail on furnishing PR bond in the sum of Rs.20,000/- with one or more sureties in the like amount; (iii) The applicant shall report the investigating officer of Kapur Bawdi Police Station as and when called for till filing of charge sheet.
