1] The applicants are apprehending arrest in CR No. 20 of 2018 dated 11.1.2018 registered with Sinhagad Police Station, District-Pune under sections 392 read with 34 of Indian Penal Code. 2] Heard the learned counsel for the applicant and the learned APP for State. Perused the record investigation. 3] The first information report is lodged on 11.1.2018 for an incident of robbery allegedly committed on 26.2.2017 by the applicants at 11.30 p.m at Vadgaon, Pune. In the first information report it is stated that, the informant traced out the concerned accused persons i.e. the applicants herein and tried to settle the matter with them. However, as the applicants 1/2
aba.1986-2018.doc did not pay the amount of Rs.1,05,000/- to the informant, the present crime is registered.
4] Undoubtedly there is delay of more than ten months in lodging the present crime. The contents of the first information report prima facie indicates that, it is not a bonafide report. In view thereof, the applicants deserve to be protected by pre-arrest bail.
Hence the following Order:
i] In the event of arrest in CR No. 20 of 2018 registered with Sinhagad Police Station, District-Pune, the applicants shall be released on bail on their furnishing PR bond in the sum of Rs.15,000/- each with one or two local sureties in the like amount.
ii] Applicants shall not tamper with the evidence and/or influence the prosecution witnesses.
