This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No.396 of 2022 registered at Kurduwadi Police Station for the offence punishable under Section 306 r/w. 34 of Indian Penal Code. 3.

It is the case of the prosecution that there was some financial transaction between the deceased and accused in the present crime. The accused were harassing him and were asking him to return their money. It is alleged that due to the said harassment on 09 August, 2022, the deceased committed suicide by consuming 1 / 2

4. I have heard the learned Counsel for the applicant and the learned APP for the State.

I have perused the First Information Report. No specific overt act is attributed to the present applicant. It appears that nothing is to be recovered from the applicant and therefore, his custodial interrogation is not necessary. Considering these facts and circumstances, I am inclined to grant anticipatory bail to the present applicant. Hence, the following order:

ORDER

(i) Application is allowed.

(ii) In the event of arrest of applicant in connection with Crime No.396 of 2022 registered at Kurduwadi Police Station for the offence punishable under Section 306 r/w. 34 of Indian Penal Code, he shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one surety in the like amount. (iii) The applicant shall attend the concerned police station from 21st October, 2022 to 23rd October, 2022 between 11.00 a.m. to 02.00 p.m. and shall co-operate in the investigation. ( N.R.
