Heard learned counsel for the applicant and the learned APP for the respondent - State. 2.
By this application, the applicant seeks pre-arrest bail in connection with C.R.No. 715 of 2013 registered with the MIDC Police Station, Mumbai, subsequently transferred to the EOW, Unit-II, Mumbai and re-numbered as C.R.No.156 of 2013, for the alleged offences
punishable under Sections 406, 420 r/w.34 of the Indian Penal Code.

The applicant and the complainant have settled their dispute amicably. Parties have entered into Consent Terms i.e. the applicant (the partner of M/s.S.M.Constructions) and the original complainant - Vinod Nandu (the partner of M/s.Vasupujya Enterprises ). The said Consent Terms are taken on record and marked "X" for identification. Learned counsel for the applicant as well as the original complainant are present and state that they have signed the said Consent Terms. They are identified by their respective counsels.

Learned APP on the instructions of the investigating officer, who is present in Court does not dispute that the parties have amicably settled the matter.

In view of the same, the applicant is granted pre-arrest bail on the following terms & conditions:
ORDER
(i) In the event of the arrest, the applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount.

The Application is allowed in the aforesaid terms and is accordingly disposed of. All concerned to act on the authenticated copy of this order.
