Ms.Deherkar, the learned counsel for the Petitioners submits that under the impugned communication, recovery is sought. However, the impugned communication does not consider the appointment and approval granted to the appointment of the Petitioners on the unaided post. The show cause notice is issued by the headmaster.

The explanation given by the Management. No orders are passed as yet directing recovery against the Petitioners. N.S. Kamble page 2 of 3

In light of that, the Petition today would be premature. The Petitioners may put forth their stand pursuant to the show cause notice. The said stand certainly would be required to be considered by the Headmaster or such authority. 4.
In case the order goes against the Petitioners, pursuant to the show cause notice, then, the Petitioners are at liberty to challenge the same in accordance with law. In that event, all contentions are kept upon.

Writ Petitions, as such, are disposed of with the aforesaid observations. No costs.
