The Applicant apprehending arrest in connection with investigation of Crime No.56/2019 of Police Station Goregaon, Mumbai under Section 417, 418, 419, 420, 406, 465, 167, 120-B r/w. Section 34 of IPC, is seeking anticipatory bail. 2.
The Applicant is one of the co-accused in said offence and the allegation against the Applicant is that he had impersonated himself as Virendra Bhandari husband of Gayatri Bhandari who Mamta Kale page 1 of 4
had entered into a Leave and License Agreement with the original owner of the shop namely Julai Munshi Yadav.

I have heard the learned counsel for the Applicant and the learned APP.

The record discloses that on 27 September 2019 interim protection was granted to the Applicant subject to the condition of attendance.

Learned APP, on instructions from the Investigating Officer who is stated to be present before the Court, states that investigation is complete and the custody of the Applicant is not required for the purpose of investigation, except that the Investigating Officer needs the specimen signature of the Applicant. Learned APP points out that the necessary documents have been obtained by the Investigating Officer. 6.
Learned counsel for the Applicant, on instructions, states that the Applicant is ready and willing to furnish the specimen signature as and when required by the Investigating Officer. 7.
Learned APP states that the Applicant be directed to attend the Investigating Officer on 23rd, 24th and 25th August 2021 between 11.00 a.m. to 2.00 p.m. It is submitted that appropriate Mamta Kale page 2 of 4
condition be imposed looking to the fact that the Applicant is not a resident of Maharashtra.

In such circumstances, the following order is passed
ORDER
1.
In the event of his arrest in connection with investigation of Crime No.56/2019 of Police Station Goregaon, Mumbai, the Applicant shall be released on bail on executing a P.R. Bond in the sum of Rs.20,000/- with one or two solvent sureties in the like amount.
2.
The Applicant shall furnish his local address as well as his native address in Mangalore, alongwith proof before the Investigating Officer.
3.
The Applicant shall attend the Investigating Officer on on 23rd, 24th and 25th August 2021 between 11.00 a.m. to 2.00 p.m. and shall furnish his specimen signature, if required.
4.
The Applicant shall attend the Investigating Officer as and when required and shall co-operate with the Investigating Agency and shall not tamper with the prosecution evidence / witnesses.
