Though the FIR as registered was under section 423, 441, 442, 445, 452, 453, 455, 463, 468 read with 34 and 120(B) IPC, ultimately after investigation respondent no.1 has presented chargesheet for the offences under sections 447, 453 and 455 IPC. The dispute has arisen out of possession of flat constructed for its members by respondent no. 2. 3.

The dispute has been amicably settled and respondent nilegaonkar 1/2

27-wp-4897.2019.odt no.2 has accordingly tendered affidavit today. Orally also respondent n.2 has given no objection. The dispute has no public angle. Therefore, accepting the joint request, we make the rule absolute in terms of prayer clause (a).
