Heard learned counsel for the applicant and learned APP for the State.

This is an application for pre-arrest bail for the offence punishable under Sections 135, 138, 150 of the Electricity Act, 2003 in connection with C.R.No.1054 of 2021 registered with Virar Police Station.

Learned APP submits that the applicant is not cooperating with the investigation despite issuance of the notice under Section 41A of the Code of Criminal Procedure (hereafter 'the Cr.PC' for short).

Learned counsel for the applicant, on instructions, submits that the applicant is willing to co-operate with the investigation and report to the Investigating Officer. Statement is accepted.

Let the applicant report to the Investigating Officer on 1st, 2nd and 3rd December, 2022, between 11.00 a.m. and 1.00 p.m. and thereafter, as and when called. In case if the Investigating Officer wants to effect the arrest if he feels that arrest is imperative in the wake of the reasons recorded by him, he may effect the arrest after giving 72 hours notice in advance to the applicant. The applicant shall furnish the details of his residential address and phone numbers to the investigating officer.
