DATED : 26th OCTOBER, 2023 P.C:- The counsel for the appellant has placed before me an order passed by the Division Bench on 12/10/2023, in Writ Petition No. 3390 of 2023, which raised a challenge to the FIR as well as the order passed under Section 156(3) of Cr.PC. By order dated 12/10/2023, it is directed that the investigation in the crime shall continue, but no charge-sheet shall be filed without leave of the Court.

In the wake of the above order, the counsel has instructions to withdraw the pending appeal and he seek necessary permission.

Permission granted. Criminal Appeal No. 1140 of 2023 stands disposed off as withdrawn.
