The applicants are seeking regular bail in Crime No.I-39 of 2016 for an offence punishable under Section 306 read with Section 34 Indian Penal Code.

The other co-accused, Bhola Tiwari and others are already protected by this Court in exercise of powers under Section 438 Criminal Procedure Code in Anticipatory Bail Application No. 1319 of 2016.

The investigation against the applicants is already complete and the chargesheet in the matter is filed. 4).

Looking to the reasons as are enumerated in the order dated 9th August, 2016 (supra) and the fact that the chargesheet is already filed and there are no criminal antecedents, it would be appropriate to release the applicant on bail. 5).

The applicants be released on bail on furnishing P.R. Bond of Rs.50,000/- (Rs. Fifty Thousand only) with two sureties in the like amount.

6).

Two consecutive absence before the trial Court will entail the trial Court to take out proceedings for cancellation of bail. 7).

The applicants shall not tamper the evidence and/or influence the witnesses in any manner whatsoever. (N.W. SAMBRE, J)
