Learned Public Prosecutor states that a pursis dated 20.10.2016 was filed by the learned Special Public Prosecutor in the trial Court, stating therein, that they do not intend to pursue their prayer under Section 438(4) of the Code of Criminal Procedure Code.

In view of the aforesaid, the impugned order dated 15.10.2016 passed by the learned Additional Sessions Judge is quashed & set aside. Accordingly, the Application and the Writ Petitions stand disposed of.
