By this application the applicant-Insurance Company has sought to condone the delay of 130 days in filing appeal against the judgment and award dated 5.1.2018 passed in MACP No. 453 OF 2009, by the MACT, Thane.

In view of the reasons stated in para 3 and 4 of the application, delay is condoned subject to payment of cost of Rs.2000/- to Juvenile pps

Issue notice to the respondents.

Ld. Counsel Mr. Mehta waives service on behalf of the respondent no.1.

The learned Counsel applicants state the the entire compensation has been deposited before the Claims Tribunal, Thane.

In the light of the said statement, execution and implementation of the impugned judgment and award dated 5.1.2018 passed in MACP No. 453 OF 2009, by the MACT, Thane, is stayed till disposal of the appeal. 6.
