Heard learned counsel for the applicant and the learned APP for the respondent No.1 - State.

By this application, the applicant seeks pre-arrest bail in connection with C.R.No. 72 of 2015 registered with the Antop Hill Police Station, Mumbai, for the alleged offence punishable under Section 53(6) of the Maharashtra Regional And Town Planning Act,

1966.

At the outset, learned APP has raised an objection. He states that the applicant has approached this Court directly. Learned counsel for the applicant states that in view of the urgency, the present application was filed directly in this Court and that he is ready to approach the appropriate Court. He states that in the meantime, the applicant be protected for one week.

Learned APP has no objection, if the applicant is granted interim protection for a period of one week to enable the applicant to file an Anticipatory Bail application before the appropriate Court.

Accordingly, the applicant shall not be arrested for a period of one week from today.

The Application stands disposed of. It is made clear, that this application has not been considered on merits and that if an application seeking anticipatory bail is filed, the learned Sessions Judge to decide the same on its own merits, uninfluenced by the interim protection granted to the applicant.
