Submission is because of the representation made by the Petitioners, the State Government has received amount in excess of Rs.40 Lakhs and the balance amount of Rs.20 Lakhs has been adjusted by appropriating it from the diesel subsidy payable to the Petitioners. URS 1 of 2

Learned APP points out that these facts on development are not on record.

If the Government has passed any orders, the Government can also decide and find out whether it is necessary to continue the criminal prosecution. Hence, we grant the Petitioners leave to approach the State Government for necessary decision in this respect. If such a representation is made within two weeks from today, the Government shall consider the same on merits within three months from today.
