The petitioner herein has challenged the Order dated 29.2.2016 whereby the learned Metropolitan Magistrate has issued process under Section 138 of the Negotiable Instruments Act. 2.

The petitioner has alternate efficacious remedy. In view of this fact, the learned Counsel for the petitioner seeks leave to withdraw the petition with liberty to file revision application before the Sessions Court, along with application for condonation of delay. 3.
