The order dated 19.07.2013 rejecting the Application Exh.69 filed by the Petitioner/original Respondent in Marriage Petition No.418 of 2007 and thereafter the order dated 08.08.2014 rejecting the Application Exh.90 for review is taken exception to by way of the above Petition. 2.

The original order has been passed in view of the nonappearance on behalf of the Respondent on 19.07.2013. Since the application has been dismissed for non-prosecution, the Learned Counsel appearing for the Petitioner states that the Petitioner/original Respondent would file a fresh application for dismissal of the said Marriage Petition in the Trial Court on the grounds which have been urged in the said BGP.

(34)-WP-10925-14.doc Application Exh.69. To the said course of action being followed by the Petitioner, the Learned Counsel for the Respondent Mr. A. V. Chatuphale has no objection. Hence, the Petitioner would be at liberty to file a fresh application for dismissal of the Marriage Petition inter-alia on the same grounds as urged in the said Application Exh.69. Needless to state that if any such application is filed, the same would be tried on its own merits and in accordance with law uninfluenced by the dismissal of the earlier Application Exh.69. It is further clarified that the contentions of the parties on all aspects are kept open. With the aforesaid directions the Writ Petition is disposed of.
