Heard learned Counsel appearing for the Petitioner and learned APP for the State. The Petitioner is seeking a direction to Respondent No.1 to file charge-sheet in respect of FIR No.112 of 2015 registered with Nigadi Police Station. The said FIR came to be registered pursuant to the orders made by the Magistrate in a proceeding under section 156(3) of the Code of Criminal Procedure, 1973. The FIR was registered as long as back on 28th February 2015. It is surprising that so far, no report is filed by the concerned police. Delay is indeed very astonishing. 2.

Learned APP having taken instructions from the patilsr 1 / 2

concerned officer who is present in the Court makes a statement that investigation into the said FIR is almost complete and appropriate report would be filed on or before 20th February 2016 before the appropriate Court. Statement is accepted as an undertaking to this Court.
