The Writ Jurisdiction of this Court is invoked against the order dated 06.08.2014 passed by the City Survey Officer, Malad. Against the said order an Appeal would lie before the District Superintendent of Land Records, Mumbai Suburban District. In view of the said statutory remedy available, there is no warrant to entertain the above Petition. The Learned Counsel appearing on behalf of the Petitioner states that such an Appeal would be filed on or before 05.05.2015 with a advance copy served on the Respondent No.4. If the Appeal is filed, the Appellate Authority i.e. District Superintendent of Land Records, Mumbai Suburban BGP.

WP-10329-14.doc 18.04.2015 District would consider the same expeditiously and dispose of the same latest by 31.07.2015. With the aforesaid directions the Writ Petition is disposed of. Parties to act on a copy of this order duly authenticated by the Court Shirestedar.
