2] The learned counsel for the applicant states that in view of the order passed by the learned Metropolitan Magistrate 33rd Court, Ballard Pier, Mumbai, on 22nd October, 2019; directing issuance process against the applicant, for the offence punishable under Section 138 read with 141 of the Negotiable Instruments Act, 1881, the instant application has become infructuous.
