Heard. Petition is filed seeking direction to the Respondents to investigate afresh into FIR bearing CR No. 134 of 2014 registered with Sangola Police Station for the offence punishable under section 379 of IPC. Mr. Yagnik, learned APP states that investigation into the said CR is already completed and A-Summary report is filed before the JMFC Sangola. Learned Counsel appearing for the Petitioner states that he has filed reply to the said A-Summary report.

In above circumstances, this writ petition is not maintainable. The Petitioner is, however, at liberty to oppose the A-Summary report before the concerned JMFC. The learned JMFC patilsr 1 / 2
shall dispose of the said protest petition only after hearing the Petitioner.
