1] Learned APP has produced on record the prisoner's medical report signed by Chief Medical Ofcer, Taloja Central Prison dated 12th December 2019 with accompanying documents. It is taken on record as Exhibit - A. 2] Letter complaining of negligence in medical attention sent by the prisoner is dated 18th August 2018. Exhibit-A shows that he has been sent to Sir J.J. Hospital, Mumbai on 11th May 2019, 24th May 2019, 22nd June 2019 and thereafter to Municipal Corporation Hospital, Navi Mumbai on 28th June 2019 and 3rd July 2019. Thereafter, he was to be sent to Sir J.J. Hospital on 10th August 2019 subject to availability of police Dinesh Sherla 1/2
3-cri.-wp-4257-18.doc escorts. The report also shows that his Body Mass Index is normal.
3] Letter dated 12th December 2019, however, does not show that on 10th August 2019 or thereafter he has been taken to Sir. J.J. Hospital.
4] In this situation, we direct the respondent to arrange for the medical examination of the prisoner at Sir J.J. Hospital and to continue further with his medical treatment as per advise of the Doctor.
