Heard the learned Counsel for the applicants and the learned APP for the State.

The applicants herein have filed the application for anticipatory bail apprehending their arrest in C.R. No.246 of 2015 registered by Deccan Police Station, Pune for offence punishable under Sections 143, 147, 149, 323, 341, 353, 506 of the IPC and Section 3 of the Damage of Public Property Act.

The applicant no.4 is the ex-student and the other applicants are the students of Film and Television Institute of India (FTII). The police have registered the offence against the applicant no.4 and other students alleging that on 17.08.2015 and 18.08.2015, the applicants along with others formed an unlawful assembly and obstructed and prevented the first informant Prashant Patharabe from discharging his public duties. The applicants are also alleged to have damaged the public property.

The applicants are the students and have no criminal antecedents. The offences alleged to have committed by the applicants are punishable with maximum punishment of 5 years. Except the applicant no.4, the other applicants being the students, there is no possibility of these applicants fleeing from the course of justice. As far as applicant no.4 is concerned, his presence can be ensured by imposing stringent conditions. Considering the above factors as well as the nature of

the offence, the applicants are entitled for bail. 5.

Hence, the application is allowed on the following terms and conditions.

(i) In the event of arrest of the applicants in C.R. No. 246 of 2015, the applicants be released on bail on furnishing bail bonds of Rs.10,000/- each with one surety in the like amount to the satisfaction of the learned J.M.F.C. (AC) Court, Pune. (ii) The applicants shall furnish their local as well as permanent addresses. The applicants shall not leave the jurisdiction of JMFC, (AC) Court, Pune till filing of the charge-sheet without prior permission of the Court.

(iii) The applicants shall report to the Investigating Officer for a period of 8 days from the date of the receipt of the order from 10.00 a.m. to 1.00 p.m. and / or as and when required by the I.O. for the purpose of interrogation and investigation. (ANUJA PRABHUDESSAI, J.)
