By a reasoned Order dated 27.9.2018 the applicant was granted interim relief. In the said order it is observed that, prima facie, it indicates that the applicant was not present at the place of incident.

In view of the above, the applicant, prima facie cannot be said to have indulged into an act attracting under Section 353 of the Indian Penal Code.+

In view thereof, and for the reasons recorded in Order dated 27.9.2018, the interim relief granted earlier by this Court is hereby confirmed. However, the condition to report to the Investigating Officer on stipulated dates is waived.
