1) The learned APP at the outset submits that in the present case, chargesheet is filed on 22/11/2016 i.e. during the pendency of this application. In view of this, the learned counsel for the applicant seeks liberty to withdraw the application.

2) Prayer is granted with further liberty to approach the Sessions Court in the changed circumstances. The learned Sessions Court shall not be influenced by the withdrawal of this application and shall consider the application on its own merits as the present application has not been heard on merits.
