The learned APP has pointed out that, in all these applications for anticipatory bail, earlier instituted similar applications are pending before the concerned Sessions Court. In avk 2/4
this view of the matter, these applications which are second anticipatory bail applications moved during pendency of earlier applications filed by all applicants before the concerned Sessions court cannot be entertained.
This position, as stated by the learned APP, is not disputed by the learned advocate for present applicants / accused. The learned advocate appearing for applicants / accused is stating that applications before the concerned Sessions court are pending since long and they are not being taken up for hearing. As such, these applications are filed.
Whatever may be the reason, but as earlier instituted applications are pending before the Competent court, I am not inclined to entertain these applications. Hence, the order :
ORDER
i) All applications are disposed of with directions to concerned Sessions court to dispose of pending applications for similar avk 3/4
relief filed by these applicants within a period of two weeks from the date of communication of this order to it. ii) Parties to act on authenticated copy of this order. (A. M. BADAR, J.) avk 4/4
