Heard the learned counsel for the parties.

By this petition under Article 227 of the Constitution of India, the Petitioner challenges the order dated 14.10.2016 passed by respondent no.3 cancelling the petitioner's Orchestra License. Against the said order, petitioner preferred Appeal before respondent no.2 on 19.10.2016 and same is pending for hearing and final disposal on its own merits.

The learned A.G.P. submits that he received instruction from the concerned officer by letter dated 24.10.2016 that they will decide the Mohite 1/2

905 wp12290-16 petitioner's Appeal within 6 weeks from today. Statement is accepted. Considering the fact that respondents undertake to decide the petitioner's appeal within 6 weeks from today, following order is passed:

a) Respondent no.2 to decide the petitioner's Appeal challenging the validity of the order dated 14.10.2016 passed by respondent no.3 cancelling the petitioner's Orchestra License be decided within 6 weeks from today. b) Till the decision of the Appeal, operation and implementation of the order dated 14.10.2016 passed by respondent no.3 stands stayed.

c) If order goes against the petitioner, stay granted by this court to continue for two weeks from the date of order passed by respondent no.2.

d) Writ Petition stands disposed of accordingly. JUDGE Mohite 2/2
