P.C.:- The Applicant is apprehending arrest in CR No. 89 of 2018 dated 24th August, 2018, registered with Koregaon Park Police Station, District Pune under Sections 452, 353, 341, 427 r/w Section 34 of the Indian Penal Code.

Heard the learned counsel appearing for the Applicant and the learned APP. Perused the record of investigation. The first information report is lodged by Mr. Vijay Dagale, an Officer attached to the Tribal Research and Training Institute, Pune. It is alleged that, on 24th August, 2018, at about 1.30 p.m. two 1/4

ssm 2 906-aba1998.18.doc persons entered into to his office and told the informant that, they want to give a representation. The informant, therefore told them to give the said representation to the Inward Clerk. It is alleged that, the said two persons approached the Inward Clerk Mr. Ravindra Gode and asked him what he knows about the caste "Dhangar" and "Dhangad". All of a sudden, one of the person hurled the "Bhandara" in the office and started giving slogans "Yalkot, Yalkot Jai Malhar". The said persons also created ruckus, caused damage to the Government property and unlawfully detained the Government Officers in the said office. They also broke glasses of the cupboards in the said office. The people from the said office noticed that, one person is standing in the corridor.

Upon making inquiry with the said person, he told that he is a Press Reporter, attached to "Dhangar Maza News" and his name is Dhananjay M. Tanle. He informed the Government Officers that, the Applicant Shekhar Bangale, resident of Solapur, from his mobile number had called him at the said office of Tribal Research and Training Institute, Pune and told him that, he was going to give representation there and requested him to take photographs of the same. In due course of time, the police appeared at the scene of offence and the present crime is registered.

ssm 3 906-aba1998.18.doc The learned counsel appearing for the Applicant submitted that, the Applicant is an Engineering student and at present his examinations are going on. He further submitted that, the co-accused has been granted regular bail by the Trial Court. He therefore, submitted that the Applicant may be protected by pre-arrest bail. The record of investigation indicates that, the staff members who were present at the office of the Tribal Research and Training Institute, Pune, in their statements have duly corroborated the version of the first informant. The identity of the Applicant as Shekhar Bangale is not in dispute. It is the Applicant, who is the perpetrator of the crime as contemplated under Section 353 of the Indian Penal Code.

Undoubtedly, the Applicant has indulged into an act thereby, preventing the Government servants from performing their lawful duty, causing damage to the Government property and creating ruckus in the Government Office. A thorough investigation at the hands of police is therefore, necessary to unearth the entire truth behind the crime, including the facts, who are the other persons who associated the Applicant in commission of the said crime.

ssm 4 906-aba1998.18.doc offence, this Court is of the considered view that, the Applicant does not deserve to be protected by pre-arrest bail. Application is accordingly rejected.
