The learned counsel for the Petitioner submits that by this Writ Petition under Article 227 of the Constitution of India, they are challenging the order dated 24.08.2018 passed by 3rd Joint Civil Judge, Senior Division, Thane below Exhibit-101 in Election Petition No.2 of 2017 allowing Respondent's Application to place on record certain documents. He submits that during the pendency of the present Writ Petition those documents are already brought on record by the Respondent by examining Advocate Snehlata Kolte, Mohite 1/2

22 wp223-19.doc Considering the submissions made by the learned counsel for the Petitioner and in view of subsequent development that impugned order dated 24.08.2018 passed by 3rd Joint Civil Judge, Senior Division, Thane below Exhibit-109 in Election Petition No.2 of 2017 is already complied, nothing survives in the present Writ Petition.

Hence, Writ Petition stands dismissed as infructuous. It is made clear that all contention of both the parties are kept open in Appeal if it is filed by them.
