Heard learned Senior Advocate for the petitioner and learned APP. Learned APP states that charge-sheet is already filed in competent Court. Petitioners are seeking time to verify this position. However, we accept the statement made by learned APP upon instructions from Investigating Officer Shri Yogesh Shinde, Khar Police Station. 2.

In present facts we permit the petitioner to take appropriate defence before the Trial Court in this respect and keeping all contentions open we dispose of the petition.
