In view of the fact that the order impugned has been challenged by the Petitioner by filing the Appeal before the District Superintendent of Land Record, Mumbai and availed of alternate remedy available under the law, the learned Counsel seeks permission to withdraw the Petition with liberty to prosecute the Appeal.

Pursis filed on 16.10.2017 be treated as not to be acted upon. 3.

Allowed to withdraw with liberty to prosecute the Appeal. The Appellate Authority is directed to hear and decode the Appeal as expeditiously as possible and preferably within six months from the date of this order.

It is expressly made clear that this Court has not gone into the merits of the case and all contentions are kept open to be raised before Appellate Authority.
