That this Hon'ble Court be pleased to quash the FIR bearing No. 3051/16 dated 19.7.2016 registered with Respondent No. 3 and all subsequent proceedings, if any, arising out of the said FIR;

Pursuant to the notices issued to the Respondents, Respondent No. 2 has tendered across the bar copy of the affidavit on 13th March, 2020 same is already taken on record. The said affidavit is filed by one Abhinav Tripathi, working as Assistant Manager - Legal with Respondent No. 2 i.e. Shemaroo Entertainment Ltd. Paragraphs 1 to 8 of the said affidavit reads as under:

I am authorized by Shemaroo Entertainment Ltd. to file present Affidavit and further also authorized to do such acts which is reflected in this affidavit. I say that Shemaroo Entertainment Ltd is the original complainant in the FIR No. 3051 of 2016 filed by authorized person at Shinhgad Police Station, Pune on 19.7.2016 punishable with offence u/s. 63 and 69 of Copy Right Act, 1957.

I say that after filing of the complaint above, there was settlement between the Petitioners and our company Shemaroo Entertainment Ltd. The subject matter of the settlement is the same subject matter which is mentioned in

4/6 FIR No. 3051 of 2016.

In view of the MOU dated 22.6.2017, the Respondent No. viz. Shemaroo Entertainment Ltd. hereby consent and give no objection to quashing of the said FIR No. 3015 of 2016.

I am filing this affidavit on behalf of Shemaroo Entertainment Ltd. for the purpose of granting no objection and consent to quashing of said FIR and I am further authorized by Board Resolution dated 27th September, 2019 in my favour authorizing me to file the present affidavit and record NOC for quashing of C.R. No. 3051 of 2016 and to give NOC or signed documents which are required to put on end to the dispute arising out of the said C.R. No. 3051 of 2016. Hereto annexed and marked Exhibit-A is the copy of Resolution by Shemaroo Entertainment Ltd.

Since the Applicants and second Respondent have amicably settled the dispute as averred in the affidavit filed by second Respondent and second Respondent has no objection for quashing the FIR No. 3051 of 2016 registered with Shinhgad Police Station, Pune on 19.7.2016 for offences punishable under Sections 63 and 69 of Copy Right Act, 1957, further continuation of proceedings arising out of aforementioned crime would be an

5/6 exercise in futility and wastage of time.

The Supreme Court in the case of Giansingh v. State of Punjab and Another1 has held that, the criminal cases having overwhelmingly and predominatingly civil flavour stand on a different footing for the purposes of quashing, particularly the offences arising from commercial, financial, mercantile, civil, partnership or such like transactions or the offence arising out of matrimony relating to dowry, etc. or the family disputes where the wrong is basically private or personal in nature and the parties have resolves their entire dispute.

In this category of cases, the High Court may quash the criminal proceedings if in its view, because of the compromise between the offender and the victim, the possibility of conviction is remote and bleak and continuation of the criminal case would put the accused to great oppression and prejudice and extreme injustice would be caused to him by not quashing the criminal case despite full and complete settlement and compromise with the victim. It is further held that, as inherent power is of wide plenitude with no statutory limitation but it has to be exercised in accord with the guidance engrafted in such power viz.: (I) to secure the ends of justice, or (ii) to prevent abuse of the process of any court.

In the light of above and since the Applicants and second Respondent have amicably settled the dispute and to that effect second Respondent has placed on record affidavit on 13th March, 2020, we are inclined to allow this Criminal Application in terms of prayer clause 'b', which reads as under :- b.

That this Hon'ble Court be pleased to quash the FIR bearing No. 3051/16 dated 19.7.2016 registered with Respondent No. 3 and all subsequent proceedings, if any, arising out of the said FIR;

Rule made absolute in terms of prayer clause 'b'. Accordingly, the Criminal Application stands disposed of.
