1] This is an application for modification of condition No.3 imposed upon the applicant while releasing him on bail by this Court by its Order dated 20th August 2018. By the said condition, the applicant was directed not to reside in the Taluka Malshiras till framing of charge. 2] This Court after taking into consideration the attending circumstances, has imposed the aforesaid condition upon the applicant, as the offence lodged against the applicant is under the provisions of the Maharashtra Control of Organised Crime, 1999. 1/2

appp.1166-2018.doc 3] The learned counsel for the applicant submitted that, the said Order was not pronounced in open Court and therefore the applicant could not opposed the said condition. By accepting the said condition, the applicant has been released on bail. It appears that, the applicant at the time of passing the said said Order accepted the aforesaid condition imposed upon him and now as and by way of an afterthought is seeking modification of the said condition, which cannot be permitted. 4] Application being misconceived is accordingly rejected.
