Heard Shri M.M.Khokhawala, the learned counsel for the applicant / appellant. The appeal filed by the applicant / appellant challenging his conviction and the sentence imposed upon him, has already been admitted. By the present application, avk 1/4

the applicant / appellant prays that pending the hearing and final disposal of the appeal, the substantive sentences imposed upon him be suspended and that he be released on bail. With the assistance of the learned counsel for the applicant, I have glanced through the evidence of the victim. I have also been taken through the medical evidence. Admittedly, the applicant was not on bail during the trial.

After considering the matter from all the angles, and keeping in mind that the applicant was not released on bail during the trial, I do not think it fit to suspend the substantive sentences imposed upon the applicant / appellant.

Instead, the appeal itself may be expeditiously heard. The application is rejected.

However, the hearing of the appeal is ordered to be expedited.

Liberty to the applicant to move the court for getting a date for final hearing of the appeal fixed, after the paper book would be ready.
