This is an application under Section 439 of Cr.P.C. for bail in C.R. No. 121 of 2017 dated 10.04.2017 registered with Khed Police Station, District Pune under Sections 363, 366 of the Indian Penal Code and Section 8, 10 and 12 of the Protection of Children from Sexual Offences Act. It is the case of the prosecution that Accused No.1 Suresh Nagu More induced the victim girl who was aged about 17 years and eight months to elope with him and the Applicant who is the elder brother of Suresh helped him in the said process of elopement. The first information report is lodged by Shri. Dattatray Gargote, father of victim girl. The perusal of statement of victim girl recorded by police and the information provided by her to the Medical Officer clearly indicates that the victim girl was having love affair with Accused No.1 Sneha Chavan 1/2
28 ba 2380-17=.doc Suresh and she eloped with him at her own will. In the present crime, the investigation is already completed and police have submitted charge-sheet. It is submitted that the victim girl and accused No.1 Suresh have performed marriage. In view of the above, the Applicant can be released on bail. Hence, the following order:
i) The applicant be released on bail in C.R. No. 121 of 2017 dated 10.04.2017 registered with Khed Police Station, District Pune on his furnishing PR bond of Rs.15,000/- with one or two local sureties in the like amount. ii) After his release from jail, the applicant shall attend the Khed Police Station once in month i.e. on every first Monday of the month between 10.00 a.m. to 12.00 noon.
iii) The Applicant shall not tamper with the evidence and/or pressurize or threaten the prosecution witnesses.
