The complainant immediately after his retirement from partnership Deed wrote a letter to bank declaring that consequent to his retirement, he is not responsible for any loan of firm or its recovery. The incident which transpired is of the year 2013 and thereafter in 2016 the police report has been lodged against the petitioner, the then Branch Manager with allegations that somebody else has forged signature of complainant on loan document.

Learned APP has invited our attention to the fact that chargesheet is already presented on 10/9/2018. FIR is of the year 2016. The defence itself raises some disputed questions. We are therefore not inclined to look into the same by exercising extra ordinary jurisdiction. By keeping all contentions of the parties open, we dispose of the petition. (SARANG V. KOTWAL, J.) (B.
