Mr.Borkar, learned counsel appearing for the petitioners states that during the pendency of this writ petition, the learned trial judge has already disposed of the civil suit in which the petitioners had made an application for amendment of the written statement and thus nothing survives in this writ petition. Statement is accepted. 2.

Writ petition is dismissed as infructuous. It is made clear that the petitioners however would be at liberty to agitate the issues raised in those proceedings in the proceedings proposed to be filed against the final decree passed by the learned trial court.
