The learned counsel for the petitioner submits that the petitioner is entitled for alternate land on account of the acquisition of his land. The petitioner has deposited 65% of the amount. The learned counsel submits that if there is any shortfall in the amount, the petitioner is ready to pay the same. The learned counsel submits that initially the proposal was given in the month April 2013, however it was transpired that the said land was not available. The petitioner again therefore filed representation on 22nd October, 2021 before the respondent no.4. The same is not being considered. We have heard the learned AGP also.

In case, the proposal of the petitioner seeking alternate land (page 54) is pending with respondent no.5, the same may be considered

bdp 50-wp-968.22.doc and decided by the Authority on its own merits in accordance with law, after considering all the relevant aspects of the matter and the policy, preferably within nine months.

Writ Petition is disposed of. No costs.
