P.C.:- By an Order dated 28th September, 2018, the Applicants were granted interim relief and were directed to attend the Investigating Officer on stipulated dates, to join the process of investigation.

Heard the learned counsel for the Applicants and the learned APP. Perused the record.

The record indicates that the Applicants have complied with the said conditions. The Applicants are in-laws of the first informant. The principal accused Shri. Pramod Sapkal i.e. the husband of the informant has already been arrested by the police and 1/2

ssm 2 17-aba2006.18.doc now has been released on regular bail.

Perusal of the first information report and other record indicates that, the observations made by the Supreme Court in the case of Arnesh Kumar Vs. State of Bihar, reported in (2014) 8 SCC 273 are squarely applicable to the present case.

In view thereof the Applicants are entitled to be protected by pre-arrest bail.

Interim relief granted by Order dated 28th September, 2018, is hereby confirmed. However, the condition to attend the Investigating Officer of the concerned Police Station is waived. Application is allowed in the aforesaid terms. (A.S. GADKARI, J.) 2/2
