Petition is filed for the following reliefs :- (a) That by an Order of this Hon'ble Court, the Writ of Mandamus or any other Writ in the nature of Mandamus be issued to direct the Respondents to install water and electricity supply to Flat Nos.C2, D2 and C5 situated at Ground floor, Tilak Nagar, Sahayog Co-operative Society, Plot No.18, Tilaknagar (chembur), Mumbai 400089 in accordance with law.
2/3 6 WP 11692-18.doc (b) That by an Order of this Hon'ble Court, pending the hearing and final disposal of the present Writ Petition water and electricity supply be installed to Flat Nos.C2, D2 and C5 situated at Ground Floor, Tilak Nagar, Sahayog Co-operative Society, Plot No.18, Tilaknagar (Chembur), Mumbai 400089."
Learned counsel for the Municipal Corporation submits that so far as water supply connection is concerned, petitioners have not filed appropriate application. Learned counsel for respondent no.5 also submits that the petitioners have not at all filed any application for electric supply. Both the learned counsel for the BMC and respondent no.5 state that if fresh application is made by the petitioners, it will be considered on its own merits and appropriate orders will be passed. Statement accepted. In light of the above, we dispose of this petition by passing the following order :
O R D E R
(1) Petitioners are at liberty to file an application to respondent nos.1 and 5 for Water Supply Connection and Electric Supply Connection respectively within a period of two weeks from today.
3/3 6 WP 11692-18.doc In the event such application is filed, respondent nos.1 and 5 shall decide the same as expeditiously as possible and preferably within a period of two weeks from the date of receipt of this order. The application shall be decided independently and on its own merits.
