1] Heard learned counsel for the Applicants.

2] It is submitted that as per the order dated 09/08/2017 the Applicants are permitted to withdraw the amount of Rs.50,000/- each, by furnishing an undertaking to this Court within three weeks, that, if the Petitioner succeeds, the amount withdrawn by the Applicants would be repaid to the Petitioner within a period of three weeks. 3] It is submitted that the said order was passed in Writ Petition; however, the amount is deposited in the Contempt Petition. In view thereof, a formal order is required to be passed in the Contempt Petition permitting the Applicants to withdraw the said amount. 1/2

osk 48-can-98-2018.odt 4] Accordingly, the Applicants are permitted to withdraw the amount of Rs.50,000/- each, as allowed in earlier Civil Application No.1102 of 2017 filed in Writ Petition No.10606 of 2012 with fresh undertaking.

5] As regards the prayer Clause (b) of the Application, seeking correction in the names of the Applicants, it is also allowed. 6] The Civil Application is disposed of in above terms. [DR.SHALINI PHANSALKAR-JOSHI, J.] 2/2
