The petition was called out in the morning session, since none appeared on behalf of the petitioner, it was kept back. When the petition was called out again in the afternoon session, nobody appeared on behalf of the petitioner. It seems that the petitioner is not interested in prosecuting the matter. Even otherwise, we find that the dispute raised in the petition is purely a private dispute between the petitioner and respondent No.1 and the disputed facts cannot be gone into by this Court in exercise of writ jurisdiction conferred upon it under Article 226 of the Constitution of India. The petition is, accordingly, dismissed in default.
